Whistleblower Rewarded for Reporting Unnecessary Testing |

WASHINGTON – Dr. James Tiesigna will receive his qui tam share under the whistleblower provisions of the False Claims Act, an estimated $300,000 of the U.S. government’s recovered $1.5 million from Dianon Systems, Inc. Dianon Systems, a reference lab in Stratford, CT, for years ran unnecessary tests on tissue specimens sent to them by various area medical facilities. The Department of Justice became involved when Dr. Tiesigna, a pathologist and former employee of Dianon, blew the whistle on these unnecessary tests sometimes paid for by Medicare or TRICARE money. Medicare fraud and deceptive/false billing offers the government a chance to recover its losses and to reward the whistleblower through the qui tam provisions of the False Claims Act. These recoveries range from 15%-30% of the total recoveries, though this rate is even higher if DOJ excedes its wait limit and the matter is pursued privated by the filing False Claims fraud attorney. |

Brooklyn Parking Lot Stabbing Victim (Inadequate Security Lawsuit) |

The Brooklyn Paper reports a former Brooklyn lawyer and violent crime victim Christopher Nesterczuk's fight against crime—with an inadequate security lawsuit. Nesterczuk was assaulted by a knife-welding maniac who slit the lawyer’s throat in a parking lot outside his building where construction was occurring. The automatic gate to keep residents safe from such violent people with criminal intent had not been activated nor did the constractor take measures to prevent such a violent assualt. |
